Please read these Terms & Conditions carefully before using the Velocity DigiAds website or engaging with our digital marketing services.
Introduction
Welcome to Velocity DigiAds. These Terms & Conditions govern your use of our website and the digital marketing services provided by Velocity DigiAds. By accessing our website, submitting an enquiry, or engaging our services, you agree to these Terms & Conditions.
Our Services
Velocity DigiAds provides digital marketing services including Google Ads management, Meta Ads management, search engine optimisation (SEO), social media marketing, lead generation, website design and development, content marketing and strategy, and digital marketing consultation.
The exact scope, deliverables, timelines, fees, and other requirements for a particular project or service may be agreed separately with the client before work begins.
Client Responsibilities
Clients are responsible for providing accurate information, required access, approvals, content, brand assets, and other materials necessary for us to perform the agreed services. Delays in providing these items may affect project timelines or campaign performance.
Clients must ensure that any materials, claims, images, trademarks, data, or other content supplied to Velocity DigiAds can legally be used for the intended purpose.
Fees and Payment
Fees for our services will be communicated and agreed upon before work begins. Depending on the service or project, payment may be required in advance, in instalments, or according to an agreed payment schedule.
Any advertising spend paid directly to platforms such as Google or Meta is separate from Velocity DigiAds’ service or management fees unless otherwise agreed in writing.
Advertising Budgets and Third-Party Platforms
Digital advertising campaigns may use third-party platforms such as Google Ads and Meta Ads. Advertising budgets, platform charges, taxes, and other third-party costs are the responsibility of the client unless otherwise agreed.
Velocity DigiAds does not control the policies, approval processes, account restrictions, algorithm changes, technical issues, or other decisions made by third-party platforms. Campaigns and advertisements must comply with the applicable platform policies.
Results and Performance
Velocity DigiAds aims to deliver services using appropriate digital marketing strategies and professional practices. However, marketing results can vary depending on factors including competition, budget, market conditions, audience behaviour, website performance, offers, and changes made by advertising or search platforms.
Therefore, unless specifically agreed in writing, we do not guarantee particular rankings, numbers of leads, sales, conversions, revenue, return on advertising spend, or other specific business results.
Cancellations and Refunds
Cancellation terms may vary depending on the service, project, or ongoing engagement and will be communicated where applicable. Clients should notify Velocity DigiAds as soon as possible if they wish to cancel or discontinue a service.
Payments for work already completed, services already provided, resources already committed, or third-party costs already incurred may be non-refundable. Any refund eligibility will depend on the circumstances of the engagement and any terms agreed with the client.
Intellectual Property
Unless otherwise agreed in writing, Velocity DigiAds retains ownership of its pre-existing materials, methods, templates, processes, strategies, and other intellectual property used in providing the services.
Ownership and usage rights for final deliverables created specifically for a client may be transferred or licensed as agreed once all applicable fees have been paid. Third-party materials, software, fonts, stock assets, plugins, platforms, and other licensed content remain subject to their respective licence terms.
Confidentiality
Velocity DigiAds will take reasonable care to protect confidential business information provided by clients and will use such information only as reasonably necessary to provide the agreed services, unless disclosure is required by law or authorised by the client.
Clients are also expected to respect confidential information, strategies, documents, pricing, processes, and other proprietary information provided by Velocity DigiAds.
Limitation of Liability
To the extent permitted by applicable law, Velocity DigiAds will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website or services, including losses resulting from third-party platforms, service interruptions, algorithm changes, account restrictions, or circumstances beyond our reasonable control.
Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot lawfully be excluded or limited.
